September 21, 2026: POST Pointed at Another Agency, So I Asked It

TRANSCRIPTTranscript (verbatim, redacted where marked)

Exhibit · Georgia POST · Sent and received

POST said it held no records of its own liability coverage, and pointed at another agency. So I asked that agency.

What it is

An open records request sent on September 21, 2026 at 7:55 AM Eastern to the records custodian of the Georgia Department of Administrative Services. It asks for the liability coverage that applies to Georgia POST, and for whether claims under Title II of the Americans with Disabilities Act and under Section 504 of the Rehabilitation Act are covered, excluded, or handled some other way.

Why it matters

On August 31, 2026 Georgia POST answered a request for its liability coverage records by stating that it located no responsive records, and directed me to the Department of Administrative Services. POST said the records were held elsewhere. This request follows that pointer, so the answer is either a document or a written statement from the agency POST named as the holder.

Item 2 asks one question: whether claims under Title II or Section 504 against a state agency are covered, excluded, or handled some other way, and which document says so.

What it shows

Item 2, verbatim:

“Records sufficient to show whether claims brought under Title II of the Americans with Disabilities Act, 42 U.S.C. Section 12132, or under Section 504 of the Rehabilitation Act, 29 U.S.C. Section 794, against a state agency are covered, excluded, or handled by another mechanism, together with the instrument that establishes that treatment. If the answer appears only in a policy exclusion, identifying that exclusion will satisfy this item.”

Delivery to the Department of Administrative Services was confirmed complete by the sending server on the same morning.

What it does not show

It does not show that any coverage exists, that any claim has been made, or that any agency has taken a position. It is a request. On September 21, 2026 at 3:25 PM Eastern, the same day, Claudia Gonzalez, Records Management, Georgia Department of Administrative Services, answered item 1 with two documents, the FY2027 General Liability Agreement and the FY2027 State Tort Claims policy, and wrote: “I will look into the remainder of your request and will provide responsive records maintained by the Department of Administrative Services.” As of September 28, 2026, items 2 through 5 have not been answered. It also takes no position on whether POST was correct that it holds no such records of its own.

Subject: Georgia Open Records Act Request Dated September 21, 2026. Liability Coverage Records Concerning the Georgia Peace Officer Standards and Training Council

“Dear Records Custodian:

This is a request under Article 4 of Chapter 18 of Title 50 of the Official Code of Georgia Annotated. I am directing it to the Department of Administrative Services because the Georgia Peace Officer Standards and Training Council answered my August 26, 2026 request for liability coverage records by stating that it located no responsive records and directing me to your agency.

Unless stated otherwise, every item below covers records existing as of September 21, 2026.

1. All liability coverage documents applicable to the Georgia Peace Officer Standards and Training Council for fiscal years 2024, 2025, 2026, and 2027, including the State Tort Claims Policy and any other liability program under which the Council is a covered entity, together with all declarations, endorsements, exclusions, and coverage limits for each. Where a policy is already published on your website, a link will satisfy this item as to that policy.

2. Records sufficient to show whether claims brought under Title II of the Americans with Disabilities Act, 42 U.S.C. Section 12132, or under Section 504 of the Rehabilitation Act, 29 U.S.C. Section 794, against a state agency are covered, excluded, or handled by another mechanism, together with the instrument that establishes that treatment. If the answer appears only in a policy exclusion, identifying that exclusion will satisfy this item.

3. Any claim file, incident notice, loss run entry, reserve, or litigation notice referencing [name redacted], referencing [internal grievance number redacted], or arising from the litigation hold and evidence preservation notice served on the Council on September 9, 2026.

4. Any notice the Department received from the Council, from the Department of Law, or from the Department of Public Safety of anticipated or pending litigation involving the Council, from January 1, 2026 through the date of your response.

5. Records sufficient to identify the risk coordinator of record for the Council and the date of that designation.

If any item will exceed twenty five dollars, please send an itemized estimate by item number before any charge is incurred, and please include the timetable that O.C.G.A. Section 50-18-71(b)(1)(A) requires for anything not available within three business days. Several items above can be answered with a one sentence statement that no record exists. I would ask that those be answered first and separately rather than held behind the cost of the others. If any record or portion of a record is withheld, please cite the specific legal authority by Code section, subsection, and paragraph, as O.C.G.A. Section 50-18-71(d) requires.”

Remaining paragraphs, signature and accessibility block omitted.

Updated September 28, 2026: the same day DOAS answer on item 1 added.
