How the Grievance Began
Before the April 10 dismissal, the record already existed. The State Bar opened the grievance, the respondent answered within days, and the Bar’s own system confirmed delivery of both of my rebuttals.
I filed a grievance with the State Bar of Georgia against a City of Brookhaven contract attorney.
The Office of the General Counsel processed the grievance I filed against a City of Brookhaven contract attorney, assigned it a grievance number, and routed it to him to respond. The notice came from the Bar’s intake address and was copied to me.
The contract attorney’s written response to the grievance is dated February 2. When the matter involved a fellow lawyer, the Bar obtained a respondent’s answer in under a week.
Returned by the Bar’s intake address, the route the State Bar designates for complainant rebuttals, on my first rebuttal submission.
My second rebuttal came later for one reason: the City of Brookhaven would not release a public record I needed through its Open Records process. I obtained it another way and sent it to the Bar by the Bar’s deadline. The Bar’s system confirmed delivery.
The Bar later admitted, in writing, that both submissions were received but not added to the grievance file before the dismissal went out.
