Does ADA Title II apply to the State Bar of Georgia?

The Bar has taken more than one position. On May 4 and May 13, 2026 it granted and approved ADA accommodations. On May 12 it wrote it is not a public entity, and on May 29 that it is not subject to Title II. Courts have generally treated state licensing and bar bodies as covered by Title II, though sovereign immunity limits what can be recovered in some circuits.

Known ADA Problems at the State Bar of Georgia

1. The grievance forms. As of September 28, 2026, the State Bar of Georgia posts three grievance forms. The June 2026 English form and the June 2026 Spanish form each carry an ADA notice naming ADACoordinator@gabar.org. The 2024 English form, still posted under the file name “Current_Grievance_Form_with_Instructions_2024”, carries no ADA notice. The Bar’s 2011 English grievance form displayed an ADA Coordinator notice with the phone numbers 404-527-8720 and 800-334-6865.

2. Seven weeks, by date. May 4, 2026: accommodations granted in writing. May 12, 2026: the Bar wrote that it is not a public entity, and its replies no longer carried the officials who had been copied. May 15, 2026: the Bar wrote that it would not engage in further substantive correspondence. May 26, 2026: the same CAPTCHA form was sent to me again. May 29, 2026: the Bar wrote that it is not subject to Title II. June 2, 2026: my contact was narrowed to accommodation requests only. 3. What the Bar publishes. From the May 29, 2026 capture of gabar.org: pages for member wellness, senior lawyers, member crisis support, diversity programming and the annual meeting. No ADA coordinator contact. No accessible format text. No disability grievance procedure.

4. Seven fixes. Publish a named ADA coordinator. Publish a disability grievance procedure. Take down the 2024 English grievance form, which has no ADA notice, or add the notice to it. Provide a filing route without a CAPTCHA. Send accessible electronic formats. Confirm file placement in writing. Answer the coverage question in one word.
