She is on this page for two reasons. She won, unanimously, before the Supreme Court of Georgia. And a page from this website is now an exhibit in her federal case.
Why Marsha W. Mignott Is On ADAMATTERS.COM:
- The State Bar of Georgia prosecuted her on a grievance brought by a prospective client, one who never became a client. That single word decided the case.
- A Special Master recommended a two year suspension. The State Disciplinary Review Board recommended one year.
- On October 24, 2023 the Supreme Court of Georgia imposed no discipline and dismissed the matter. Per curiam. All Justices concurred.
- On April 23, 2023, while the disciplinary proceeding was still running, she filed a putative class action in the Northern District of Georgia alleging her prosecution was racially discriminatory under 42 U.S.C. 1981. It named the State Bar of Georgia Foundation, Inc., the State Bar of Georgia Office of the General Counsel, and an assistant general counsel in his official capacity.
- On December 27, 2023 the district court dismissed that case without prejudice, for lack of subject matter jurisdiction, on the ground that the Supreme Court of Georgia has exclusive jurisdiction over attorney misconduct.
- On July 30, 2025 the Eleventh Circuit vacated that dismissal and sent the case back. Published opinion, Chief Judge William Pryor.
- On September 14, 2026 she filed Document 53, seeking leave to file a supplemental response to the renewed motion to dismiss. Page two of its Exhibit B is a published exhibit from this website.
What the courts said, in their own words
“We therefore impose no discipline and dismiss this matter.”
Supreme Court of Georgia, October 24, 2023, S23Y0974, reported at 317 Ga. 764. Per curiam, all Justices concurring.
“Because federal, not state, law governs the subject-matter jurisdiction of the district court, we vacate and remand for further proceedings.”
United States Court of Appeals for the Eleventh Circuit, No. 24-10327, published, July 30, 2025, Chief Judge William Pryor.
