Burgess sent operational answers to the April 30 questions and confirmed the misclassification a second time.

What had to be true

For Burgess to answer routing and reviewer-assignment questions, the office had to acknowledge that overlapping submissions could be lost or inconsistently classified, the very failure that produced the dismissal.

What the Bar said

Burgess confirmed the Feb 3 and Feb 20 submissions and original grievance "will be thoroughly reviewed during the reconsideration process," and explained reviewer assignment runs by "alphabetical distribution" by the respondent's last name. She added, "Please note that OGC@gabar.org is not an email address associated with our office," flagging the unreliable address the complainant had been using.
