May 1, 2026: GIRMA’s Lawyer Calls Five Accommodation Requests Harassment

Five written requests for an ADA contact and a phone call. The answer, from the insurer’s lawyer: what is your disability, this is harassment, and in my opinion you have committed a crime.

What it is

A two-page letter on Westbury Law, LLC letterhead, dated May 1, 2026, from James R. Westbury, Jr., writing for the Georgia Municipal Association and GIRMA “with respect to coverage and claims.” It answers my April 14 notice to Larry Hanson. It arrived by email at 12:08 PM with a cover message that began “Dear Mr. [name redacted; the City of Brookhaven’s City Attorney]:” and went to nine other people.

Why it matters

This is the institution’s first and only substantive answer to five written accommodation requests. It says GIRMA does not have to have an ADA coordinator, asks me what my disability is, says GIRMA will comply with the ADA voluntarily and may stop, and describes my emails as harassment and annoyance. It also gives an opinion that I committed a crime. I write every one of these letters with voice software because I cannot use my hand.

What it shows

“You have presented dozens of emails to Ms. Boscoe and others in volume and frequency that is not productive and has crossed into the realm of harassment.” “Your efforts seem to be less intended to vindicate any bona fide legal right than to exploit laws unrelated to the merits of the claim for the purpose of annoyance.” The emails in question are the five requests on this site and the emails written in response to intake notices that Gallagher Bassett itself said were set up by mistake.

What it does not show

An ADA contact, a grievance procedure, or any determination on the March 13, March 16, April 2, April 6, or April 12 requests. It asks, on May 1, what the disability is.

Dear Mr. [redacted]:

This firm represents the Georgia Municipal Association (GMA) and the Georgia Interlocal Risk Management Agency (GIRMA) with respect to coverage and claims. I have been asked to respond to your letter to Larry Hanson dated April 14, 2026.

Contrary to your contention, GIRMA is not required to designate an Americans with Disabilities Act (ADA) coordinator. 28 C.F.R. § 35.107 only applies to a “public entity that employs 50 or more persons.” GIRMA is an association formed by intergovernmental agreement of its participants and has no employees. Nevertheless, it is GIRMA’s intention to voluntarily comply with any legal requirements that may apply to it under the ADA in deference to your assertion, at this time. GIRMA does reserve the ability to cease such voluntary compliance in any future correspondence.

GIRMA has designated me as the person for you do deal with, and I will be happy to assist you. In this respect, I need two pieces of information:

(1) What is your disability? In other words, what is your impairment or functional limitation?

(2) What is the specific accommodation requested and the program or service at issue?

After a careful review of the documentation submitted with your April 14 letter, I can find no description of a disability or request for a specific accommodation to prevent you from being “excluded from participation in or … denied the services, programs, or activities” of GIRMA. Specifically, I reviewed the March 13, 2026 email to Belinda Boscoe referenced in your letter that purports to be a written notice of disability.

[Paragraph redacted. Outside this record.] You do not have standing to present this claim on behalf of another person. The presentation of a legal claim on behalf of another is, in my opinion, the unlawful practice of law which is prohibited under Georgia law without a license. O.C.G.A. § 15-19-51.

Nevertheless, your claim was presented, investigated, considered, and denied. You have presented dozens of emails to Ms. Boscoe and others in volume and frequency that is not productive and has crossed into the realm of harassment. If you are unsatisfied with the decision as to the claim that has been presented, you are welcome to present your claim in court. Your efforts seem to be less intended to vindicate any bona fide legal right than to exploit laws unrelated to the merits of the claim for the purpose of annoyance.

To the extent that your letter seeks to present claims under the GIRMA Member Coverage Agreement between the City of Brookhaven and GIRMA, you are not a party to that agreement and have no rights. Any rights to coverage belong to the City of Brookhaven and as Named Member and other Members as defined in that agreement. This definition does not include a third-party claimant.

In any case, if you believe that you are entitled to further consideration of your disability, please communicate the nature of your disability to me and your accommodation request, and I will take appropriate steps to the ensure full compliance with the law by GIRMA.
